This instruction rescinds In Orders 2004/25, NSW Fire Brigades logos.
The NSWFB logo defines the NSWFB’s identity in the community. Its correct use and appearance is essential in order to maintain the NSWFB’s good image and high visibility in the community.
The current NSWFB logo is registered under the Trademarks Act 1995 to the Crown in right of the State of NSW as the heraldic symbol of the NSWFB.
Old NSWFB logos are protected under the Copyright Act 1968.
Under Section 63B of the State Emergency and Rescue Management Act, it is an offence to:
· manufacture, sell, exchange or hire NSWFB logos without authority
· use or display NSWFB logos with the intention to deceive.

No person or organisation may use the NSWFB logos for any purpose without the written permission of the Commissioner.
Individuals or organisations seeking approval to use the NSWFB logos must make a written submission to the Commissioner specifying the purpose, design, location, quantity and costing of the project.
Use of the NSWFB logos on any items of clothing except official NSWFB uniform is not permitted.

The State Emergency and Rescue Management Amendment Act 2005 came into effect on 26 October 2005. This amendment makes it an offence to:
· manufacture, sell, exchange or hire NSWFB insignia or uniform without authority
· use or display NSWFB uniform or insignia with the intention to deceive, ie to impersonate a NSWFB employee.
Note: The NSWFB’s logos are also protected by copyright and trademark laws. Under the policy on NSW Fire Brigades logos (see page 4) no person or organisation may use the NSWFB’s logos without written permission.
The new Section 63B of the State Emergency and Rescue Management Act states:
63B Offences relating to emergency services organisations
(1) A
person who manufactures or sells emergency services organisation insignia is
guilty of an offence.
Maximum penalty: 50 penalty units
(2) A
person who:
(a) uses
or displays emergency services organisation insignia, or
(b) impersonates
an emergency services organisation officer,
with the intention to deceive is
guilty of an offence.
Maximum penalty: 50 penalty units
(3) A person is not guilty of an offence
under this section if:
(a) the
person’s conduct is authorised by the relevant emergency services organisation,
or
(b) the
person establishes that the conduct is for the purposes of a public
entertainment, or
(c) the
person establishes that the person has a reasonable excuse.
(4) In this section:
emergency services organisation
insignia means:
(a) any
items (being uniforms, insignia, emblems, logos, devices, accoutrements and
other things) that are generally recognised as pertaining to an emergency
services organisation (other than NSW Police) or as being used by an emergency
services organisation officer, or
(b) any
parts of any such items, or
(c) any
reasonable imitation of any such items or parts, or
(d) any
thing or class of thing prescribed by the regulations as being within this
definition (whether or not it may already be within this definition)
but does not include any thing or class of thing
prescribed by the regulations as being outside this definition.
emergency services organisation officer includes
an employee, member, volunteer or any other person who exercises functions on
behalf of an emergency services organisation (other than NSW Police).
sell means sell, exchange or let on hire,
and includes:
(a) offer,
expose, possess, send, forward or deliver for sale, exchange or hire, or
(b) cause,
suffer or allow any of the above.
The aim of this legislation is to restrict access to emergency services’ uniforms and insignia that could be used by terrorists to impersonate emergency services personnel. For example, last year official uniforms and insignia of NSW Ambulance Officers were offered for sale on eBay.
Due to their legislated powers and position of trust within the community, emergency services personnel have access to many of the kinds of sites that could potentially be targeted in a terrorist attack. For example, it is unlikely that a person in an official NSWFB uniform would be challenged to provide evidence that they are responding to an emergency call.
Removing the ‘unofficial market’ in emergency services’ insignia and uniforms will help minimise the opportunity for them to be used by those with the wrong intent.
Specific exemptions apply for someone using uniform or insignia for public entertainment or with other reasonable excuse. These exemptions are intended to protect, for example, members of the community staging fundraising events to support emergency services. They also offer protection to genuine collectors of emergency services uniform or insignia.

NSWFB uniforms or insignia that are disposed of must be destroyed by cutting, shredding or another means so as to make them unusable prior to disposal.
NSWFB patches may be exchanged with genuine collectors or those with a showcase of emergency services insignia who have no intention to deceive through their display.

This instruction is to be read in conjunction with the Recommended practice for wearing of uniforms and personal protective equipment which is available on the Intranet on Station Portal under Recommended Practices. The Recommended practice provides information on the correct operational use and maintenance of uniforms and personal protective equipment for all staff of the NSW Fire Brigades.
The Recommended practice consolidates and standardises information previously published in In Orders. It replaces the In Orders listed in section 9 below.
The Recommended practice for wearing of uniforms and personal protective equipment is now the only policy covering the wearing of uniforms and personal protective equipment.
It is essential that all officers and staff make themselves conversant with this recommended practice and ensure that it is fully complied with at all times.
All officers and managers are to ensure that their staff make themselves familiar with the Recommended practice.

Each section of the Recommended practice contains illustrated fact sheets relating to the wearing of particular uniforms and personal protective equipment
The following
extracts from the Recommended practice are highlighted for the attention
of all staff.
The NSW Fire Brigades (NSWFB) is committed to maintaining and improving occupational health, safety and welfare in the workplace, and reducing the incidence and severity of workplace accidents, injuries, illnesses and near-misses.
In accordance with the Occupational Health and Safety Act 2000 and regulations, the NSWFB provides a range of protective uniform clothing and personal protective equipment (PPE).
All NSWFB staff have a responsibility to wear the correct uniform and PPE appropriate to each incident and as directed by the Officer-in-Charge or Incident Controller.
The principal reason for the NSWFB’s insistence on the wearing of uniforms and PPE is the provision of protection to the wearer. Wearing uniforms and PPE also ensure that:
· firefighters can be easily identified
· the NSWFB maintains a professional image, and
· the public have more confidence in the NSWFB.
All staff are responsible for wearing the appropriate uniform and PPE for the risks in their workplace at the time.
The Recommended practice sets minimum standards. Commanders and supervisors shall monitor compliance with the minimum requirements.
New South Wales is a diverse State with dramatic variations in climatic conditions. Consideration should be given by the Officer-in-Charge to changes of uniforms and PPE to suit the conditions.
Note: Operational
considerations must take precedence over comfort; additional considerations
include the nature of the incident, the physical stress on firefighters and
climatic conditions.
Consistency in dress when in view of the public assists in maintaining public confidence in the NSWFB by re-enforcing our image as professional, prepared and confident.
Subject to OHS and operational considerations, crews should wear consistent dress so that they reinforce the professional image.
Note: This applies to
both the wearing of PPE and dress uniform.
The following policies relating to uniforms and PPE must be observed:
· All NSWFB employees have a responsibility to reflect the professionalism of the NSWFB and assist in maintaining their own and others safety by wearing their uniform and PPE correctly at all times.
· The Officer-in-Charge and Incident Controllers have a responsibility to monitor and maintain the required standards of safety and professional appearance.
· All NSWFB staff are to be properly attired at all times, and the highest standard of cleanliness and appearance is to be maintained.
· Only a dress uniform may be worn on journeys to and/or from the workplace and home, except in the case of retained Officers and firefighters who may wear duty wear if responding to an emergency call or attending a drill. Pullovers or cool weather jackets may be worn in lieu of galateas except on ceremonial occasions.
· Turnout jackets are not to be worn by firefighters on watchroom duty, general station duties, or in clean areas of the station
· Undershirts, T-shirts etc. worn under dress shirts must not be visible, even when no tie is worn.
· Appropriate head dress shall be worn in accordance with the various uniform combinations as illustrated in the recommended practice.
A complete dress uniform, including galatea, broad brimmed hat and ankle boots/shoes must be maintained at the station or place of work at all times, and is to be kept in a clean and serviceable condition.
A complete firefighting uniform kit (ie duty wear uniform, turnout jacket, flash hood, bushfire jacket, over-trousers, structural firefighting and multi-purpose helmet, boots and gloves) is to be retained at the station or place of work at all times, and is to be kept in a clean and satisfactory condition.
Officers-in-Charge should constantly monitor the above requirement in consultation with firefighters under their command
Any spare uniforms must be secured in the station locker.
Firefighters proceeding on annual leave, or having any other cause to remove their uniform from the station peg, shall indicate the reason for its absence by means of a suitable tag attached to the peg. Such tags shall be removed immediately the uniform is replaced on the peg.
NSWFB uniforms shall not be worn whilst off duty. However, the Commissioner may grant permission for a firefighter to wear dress uniform for a specific occasion, provided that:
· an application in writing is addressed to the appropriate Director or Regional Commander stating the circumstances of the occasion; and
· that no claim for any purpose shall be made against the NSWFB as a result of approval being granted.
The Commissioner may also grant permission for off-duty staff to wear dress uniform at a specific occasion such as a NSWFB funeral, sporting event or Anzac Day March.
Personnel should not alter any article of the NSWFB uniform without permission. A breach of this requirement could be an offence against discipline.

The NSW Fire Brigades Business Improvement Group has reviewed the Station Register. A survey of selected greater Sydney area and country stations found that the information collected in 11 of the 27 sections in the Station Register is either no longer relevant or is recorded using other systems within the NSW Fire Brigades.

The NSWFB collects and maintains in FireCAD the details of the location of dialysis (kidney) machines in the community.
This information is included in dispatch printouts when a station is responded to a site where a dialysis machine is installed. Dialysis machines require water and electricity to function.
For information about emergency procedures for dialysis machines see In Orders 1992/6.
If you are contacted by an Area Health Service, a Dialysis Centre or a patient with information about a dialysis machine in your station area, refer the caller to the FireCAD Database Administrator at Operational Communications on (02) 9318 4812, or by fax on (02) 9318 4382. The information required is:

· name of owner or user
· effective date, and
· if possible, the length of time the machine is being used.
The FireCAD Database Administrator will enter the information in FireCAD.

To ensure that
refreshments arrive on the incident ground in a timely manner, an arrangement
has been entered into with the Salvation Army to provide meals and refreshments
to firefighting personnel engaged in extended incidents.
The arrangement commenced on 1 March 2005 and provides a service covering the Greater Sydney Metropolitan area.
The Response Coordinator at the Sydney Communication Centre will contact the Salvation Army to instigate the service for 3rd Alarm notification, where the Operational Commander has responded to a hazmat incident or where the Incident Controller decides it is necessary.

This instruction rescinds In Orders 2002/13, Aerial appliances - roster eligibility.
The aerial appliance training and operating requirements for Aerial Appliance Operators to maintain their roster eligibility are as follows:
1.1 All operators must carry out a minimum of 15 hours training and/or operational time in every 23 sets of shifts (six-month period).
1.2 A minimum of one hour of the 15 hours of training and/or operational time is required on SEV aerial appliances that the operator is qualified on.
1.3 Driving time on aerial appliances does not count as operational time.
1.4 Eligibility to be rostered on an aerial appliance is dependent upon operators maintaining the required number of hours.
1.5 It is the responsibility of operators and their supervisors to ensure they maintain their operating skills.
1.6 Operational Commanders and Country Inspectors should, where possible, ensure that relieving firefighters with an aerial appliance qualification relieve at aerial stations so they can maintain their roster eligibility.
1.7 Station Commanders, Operational Commanders and Country Inspectors must make sure appliances are available for aerial operators to maintain their roster eligibility. Contact the Fleet Officer for aerial SEV availability. Contact the Appliance Training Unit for cross training and re-qualification.
2.1 Operating times must be recorded in the aerial log section of the Station Register and the Operator’s Training Logbook. If aerial logs are not kept up to date and there is no history of an operator maintaining their roster eligibility, the operator will be required to pass an assessment before being allowed to operate aerial appliances.
2.2 Operational Commanders, Country Inspectors and Station Commanders and Appliance Training Instructors will verify entries in the aerial log.
2.3 The Appliance Training Unit will carry out audits of the station register aerial logs and personal Training Logbooks.

Note: Entries in the aerial log must contain all the relevant information on the type of call or training/drill exercise. The phrase ‘all evolution’ is not a suitable entry.
4.1 To ensure that the NSWFB meets its obligations under the Occupational Health and Safety Act 2000, authorised Appliance Training Instructors will monitor operators during drills, training/skills maintenance sessions and operations.
4.2 An operator may be removed from operating an aerial appliance if, in the opinion of the Manager Appliance Training or an authorised Appliance Training Instructor, they are not competent with the appliance they are operating.
5.1 If an operator is removed from operating an aerial appliance, the return to operating status will be by a combination of training and assessment as directed by the Manager Appliance Training.
5.2 Only an authorised Appliance Training Instructor can reinstate operators whose eligibility has lapsed. Assessments will consist of any or all of the following methods:
· theory
· practical
· oral.
